These Terms of Service ("Terms") govern your access to and use of the msg10x platform, including our website, mobile applications, API, and all related services (collectively, the "Service"), provided by msg10x Technologies Private Limited ("msg10x", "Company", "we", "us", or "our"), a company incorporated under the Companies Act, 2013, with its registered office at Mumbai, Maharashtra, India.
By registering for an account, clicking "I Agree", or otherwise accessing the Service, you ("Customer", "you") agree to be legally bound by these Terms and our Privacy Policy. If you are accepting on behalf of a company, you represent and warrant that you have authority to bind that entity.
If you do not agree to these Terms, you must not access or use the Service.

The WhatsApp messaging features of the Service are provided through the Meta WhatsApp Business API. Your use of these features is additionally governed by:
You acknowledge that Meta may independently restrict or terminate your access to the WhatsApp Business API for violations of their policies, independently of msg10x. msg10x is not liable for such actions by Meta.
You are responsible for obtaining valid opt-in consent from all customers before sending them WhatsApp messages. msg10x provides tools to manage consent but is not responsible for your opt-in process.
msg10x offers subscription plans on monthly and annual billing cycles. Pricing is displayed on our Pricing page and is subject to change with 30 days' notice.

msg10x offers a 14-day free trial with full access to all features on the Growth plan. The following conditions apply:
You own your data. msg10x claims no ownership over any customer data, conversation data, or business data you input into or generate through the Service.
The Service, including all software, algorithms, AI models, designs, text, graphics, logos, and trademarks, is the exclusive property of msg10x Technologies Private Limited or its licensors and is protected by Indian and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service solely for your internal business purposes during your subscription period.
"msg10x", the msg10x logo, and all related marks are trademarks of msg10x Technologies Private Limited. You may not use our trademarks without prior written consent.
To the maximum extent permitted by applicable law, msg10x and its directors, employees, agents, and licensors shall not be liable for:
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. msg10x makes no warranty that the Service will be uninterrupted, error-free, or meet all your requirements. Our target uptime SLA is 99.5% monthly, with exceptions for scheduled maintenance communicated 48 hours in advance.

Effect of Termination
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.
Before initiating legal proceedings, both parties agree to attempt resolution through good-faith negotiation for 30 days. If unresolved, disputes may be referred to arbitration under the Arbitration and Conciliation Act, 1996, with a single arbitrator appointed by mutual agreement, proceedings conducted in English in Mumbai.
